2.1.1 Account Information
When you create a BrighterBalance account, we collect:
Name: Your first and last name
Email Address: Your professional or personal email
Password: Encrypted and never stored in plain text
School/District Affiliation: Name of your school or district (optional during beta)
Invite Code: Code used to create your account (during limited access periods)
2.1.2 Student Information
When you log student behaviors, we collect:
Student Names: First and last names (or identifiers you choose)
Class Assignments: Which class(es) each student belongs to
Avatar Colors: Optional color selections for student avatars
Behavior Logs: Specific data about each behavior entry including behavior type, timestamp, notes, and teacher who logged it
Important: We only collect Student Information if and when you choose to enter it. You control what student data exists in BrighterBalance.
2.1.3 Class and Organizational Information
Class Names: Names you give to your classes
Class Colors: Optional color coding for classes
Class Schedules: Optional start/end times and days of week
2.1.4 Communications
Support Requests: Content of emails or messages you send to hello@brighterbalance.app
Feedback: Survey responses, feature requests, bug reports
Contact Form Submissions: Name, email, message content submitted via our contact form
2.2.1 Usage Information
When you use BrighterBalance, we automatically collect:
Log Data: Pages visited, features used, actions taken, time spent, buttons clicked, errors encountered
Device Information: Device type, operating system, browser type and version, screen size, language settings
Connection Information: IP address, Internet Service Provider, approximate geographic location (city/state level), connection type
2.2.2 Performance and Diagnostic Data
Error Logs: Information about crashes, bugs, and errors
Performance Metrics: Page load times, API response times
Session Information: Login times, logout times, session duration
2.2.3 Offline Data Storage
If you use our Progressive Web App (PWA) with offline functionality:
IndexedDB Storage: Behavior logs stored locally on your device when offline
Service Worker Cache: Application files cached for offline access
Browser Cache: Temporary storage for faster loading
Note: Offline data is stored on YOUR device, not our servers, until you sync.
We do NOT collect the following types of information:
Student Contact Information: Home addresses, phone numbers, parent email addresses
Student Demographics: Date of birth, age, race, ethnicity, gender (unless you manually enter in notes)
Student Identifiers: Social Security numbers, student ID numbers
Student Academic Data: Grades, test scores, GPA (unless you manually enter in notes)
Student Photos: We use color avatars only, no actual photographs
Biometric Data: Fingerprints, facial recognition, voice prints
Precise Geolocation: GPS coordinates, exact location tracking
Health Information: Medical diagnoses, medications, health records
Social Media Data: Social media profiles, posts, connections
Browsing History: Websites you visit outside BrighterBalance
Payment Information: Credit card numbers (if/when we charge, this is handled by third-party payment processor)
We use information to:
Operate the platform: Maintain user accounts, store behavior logs, sync offline data
Provide core features: Behavior logging, student management, class organization, data export
Generate AI insights: Analyze behavior patterns to provide coaching recommendations (using anonymized data)
Enable offline functionality: Store data locally so you can log behaviors without internet
Authenticate users: Verify your identity when you log in
Communicate with you: Send important service notifications, password reset emails
Provide customer support: Respond to questions, troubleshoot issues, fix bugs
We use aggregated, anonymized information to:
Understand usage patterns: Which features are most useful, which are confusing
Improve user experience: Optimize workflows, simplify interfaces, fix pain points
Develop new features: Build features that address real teacher needs
Enhance AI insights: Improve the quality of coaching recommendations (using anonymized behavioral patterns only)
Optimize performance: Speed up the app, reduce errors, improve reliability
Conduct research: Publish findings on educational best practices (no identifiable students or schools)
Important: When we use data for improvement, we ALWAYS anonymize it first:
All student names removed
All teacher names removed
All school names removed
No way to trace data back to individuals
Aggregated across many users
Example of acceptable use:
"Teachers log positive behaviors most frequently in the morning hours"
NOT acceptable:
"Johnny Smith at Lincoln Elementary had 12 behaviors on Tuesday"
We use information to:
Detect fraud and abuse: Identify suspicious account activity, prevent unauthorized access
Enforce our Terms: Investigate violations, protect against misuse
Comply with legal obligations: Respond to valid subpoenas, court orders, legal process
Protect safety: Prevent harm to individuals, prevent illegal activity
Maintain security: Monitor for security threats, prevent attacks
Conduct audits: Verify compliance with our own policies and contractual obligations
We will NEVER:
Sell or rent your data to third parties for any purpose
Use student data for advertising or marketing (to you, students, or anyone)
Create advertising profiles of students or teachers
Use student data to train AI models (we use anonymized patterns only)
Share identifiable student data with third parties except as described in Section 4
Use data for purposes incompatible with providing educational services
Track students across websites or apps outside BrighterBalance
Build dossiers on students beyond what's necessary for educational services
Use data to target students with content or recommendations based on their personal characteristics
Absolute Commitment
We do NOT sell, rent, lease, or trade: Student data, Teacher data, School/district data, Any personal information
This commitment is absolute and permanent.
We share information with trusted third-party service providers who help us operate BrighterBalance:
All service providers:
Are required to protect your information
May only use information to provide services to us
Are prohibited from using data for their own purposes
Are bound by Data Processing Agreements
Must comply with applicable privacy laws
Are located in the United States
If you use BrighterBalance through a school or district account:
School/district administrators may access: All student data you create (they own it under FERPA), Your account activity and usage, Behavior logs for compliance audits, and Reports and analytics.
This is appropriate because: Educational institutions own student data under FERPA (teachers are custodians), Schools need to respond to parental requests, Districts must ensure compliance with policies, and Administrators may need data when teachers leave employment.
Individual teacher accounts (current beta): Your school does NOT automatically have access to your data. You own your account and data. You control who sees your information.
We may disclose information when required by law:
Legal Process: Valid subpoenas, Court orders, Search warrants, Regulatory requests
Legal Compliance: Compliance with applicable laws, Response to government requests, Cooperation with law enforcement (when legally required)
Protection of Rights: Enforce our Terms of Use, Protect against fraud or security threats, Protect the safety of individuals, Defend legal claims
If BrighterBalance is involved in a merger, acquisition, or sale of assets:
Information may be transferred to the acquiring entity
We will notify you via email and/or prominent notice on our website
You will have the opportunity to export your data before the transfer
The acquiring entity will be bound by this Privacy Policy (or provide equivalent protections)
We may share information with third parties when you explicitly consent:
Sharing anonymized examples in case studies (with your written permission)
Testimonials or quotes (with your written permission)
Research collaborations (with institutional approval)
Integration partners you authorize (future feature)
We may share anonymized, aggregated data publicly or with partners. Examples include: "Teachers using BrighterBalance log an average of 15 behaviors per week" or "Positive behaviors are logged 3x more frequently than needs-attention behaviors."
This data cannot be traced back to individual students, teachers, or schools. It is aggregated across many users and has all personally identifiable information removed.
Student data receives our highest level of protection. We treat every piece of student information with the utmost care and follow strict protocols to ensure privacy and security.
"Student Data" means personally identifiable information about students, including:
Student names
Behavior logs associated with students
Class assignments and rosters
Any notes that reference specific students
Any information that could identify an individual student
The Family Educational Rights and Privacy Act (FERPA) protects student education records.
When you use BrighterBalance as a teacher employed by a FERPA-covered institution:
BrighterBalance acts as a "School Official" with legitimate educational interests
We use Student Data only to provide educational Services
We do not re-disclose personally identifiable information except as permitted by FERPA
We maintain reasonable security measures to protect Student Data
We destroy or return Student Data upon request
We cooperate with institutions in providing parental rights under FERPA
FERPA provides parents and eligible students the right to:
Inspect and review education records
Seek amendment of inaccurate records
Consent to disclosures of personally identifiable information (with exceptions)
File complaints with the U.S. Department of Education
To exercise FERPA rights: Contact your school or district (not BrighterBalance directly). The institution will coordinate with us to fulfill requests.
We commit to the following protections for ALL Student Data:
5.3.1 No Sale or Trade
We will NEVER sell, rent, lease, or trade Student Data to any third party for any purpose.
5.3.2 No Advertising
We will NEVER use Student Data to target advertisements to students or teachers, create advertising profiles, serve behavioral advertising, or build marketing databases.
5.3.3 No Amassing Dossiers
We will NOT create profiles of students for purposes unrelated to providing educational Services.
5.3.4 Purpose Limitation
We use Student Data solely to provide the behavior logging and coaching Services, improve the Services (using anonymized data only), comply with legal obligations, and enforce our Terms.
5.3.5 Data Minimization
We collect only the minimum Student Data necessary to provide effective Services.
5.3.6 Security
We implement strong security measures (see Section 7).
5.3.7 Transparency
We clearly disclose our data practices in this Privacy Policy.
5.3.8 Parental Rights
We cooperate with institutions to provide parents access to their child's behavior records, ability to request corrections and deletion (subject to school policies), and copies of data in machine-readable format.
Important:
Educational institutions (schools/districts) own Student Data, not individual teachers or BrighterBalance.
This means: Institutions control Student Data created by their employees, Teachers are custodians of data (not owners), Upon teacher departure data belongs to the institution, and BrighterBalance processes data on behalf of institutions.
Individual beta testers: During beta testing with individual accounts, you control your data. Upon production launch with institutional accounts, data ownership transfers to institutions.
BrighterBalance uses AI (specifically, Anthropic's Claude language models) to:
Analyze behavior patterns and trends
Generate coaching insights and recommendations
Suggest intervention strategies
Identify potential areas of concern or improvement
We send ONLY anonymized behavior patterns to AI providers:
What IS sent:
Anonymized behavior types (e.g., "positive behavior," "needs-attention behavior")
Timestamps (e.g., "behavior at 10:15 AM")
Frequency patterns (e.g., "5 positive behaviors, 2 needs-attention behaviors in one day")
Contextual patterns (e.g., "behaviors during transition times")
What is NOT sent:
Student names
Student identifiers
Teacher names
School names
Specific notes that contain names
Any personally identifiable information
We do NOT use Student Data to train AI models.
Student Data is NOT used to train or improve Anthropic's Claude models
Student Data is NOT used to train or improve BrighterBalance's AI algorithms
Identifiable student information NEVER contributes to AI model development
AI-generated insights may be:
Incomplete or incorrect
Biased based on training data
Inappropriate for specific contexts
Lacking nuance or cultural understanding
Missing important patterns
Over-emphasizing unimportant patterns
AI is a tool to support, not replace, teacher professional judgment.
You must review all AI suggestions with professional judgment, not rely solely on AI for important decisions about students, and use your training and experience as the primary decision-making tool.
We do NOT use fully automated decision-making that has legal or similarly significant effects. All AI-generated recommendations are suggestions only, require human review and approval, do not automatically trigger actions, can be ignored or overridden, and are presented alongside disclaimers about accuracy.
Teachers always maintain full control over how (or whether) to act on AI insights.
We take data security seriously and implement industry-standard measures to protect your information.
However, no system is 100% secure. You acknowledge that use of the internet carries inherent risks that cannot be entirely eliminated.
Encryption
In Transit: All data transmitted using TLS 1.3 (Transport Layer Security)
At Rest: All Student Data encrypted using AES-256 encryption in database
Backups: All backups encrypted with AES-256
Access Controls
Row Level Security (RLS): Database ensures teachers can only access their own students' data
Role-Based Access Control (RBAC): Team members have minimum necessary permissions
Authentication: OAuth 2.0 secure authentication protocols
Two-Factor Authentication (2FA): Optional additional security layer (recommended)
Application Security
Web Application Firewall (WAF): Protects against common attacks
DDoS Protection: Distributed denial of service attack mitigation
Content Security Policy (CSP): Prevents cross-site scripting (XSS) attacks
HTTPS Enforcement: All connections require HTTPS (no HTTP)
You are responsible for:
Account Security: Choosing a strong, unique password, not sharing your password, enabling 2FA, logging out of shared devices
Device Security: Securing devices that access BrighterBalance, not using Services on public computers, installing security updates promptly
Reporting: Reporting suspected security incidents to hello@brighterbalance.app immediately
If you suspect unauthorized access:
1. Change your password immediately
2. Email hello@brighterbalance.app with subject "SECURITY INCIDENT"
3. Report to your school IT department
Active Accounts
We retain Student Data for as long as your account is active and in use. No automatic deletion while you're actively using BrighterBalance.
Inactive Accounts
Accounts with no activity for 12+ months may be deleted with 30 days advance notice. We'll email you before deleting inactive accounts.
Deleted Accounts
Data deleted from production systems immediately upon account deletion. Data removed from backup systems within 90 days of deletion.
Archived Students
Individual students marked as "archived" remain accessible for 3 years. After 3 years, archived students are eligible for permanent deletion.
You can delete data at any time:
Delete Individual Students: Navigate to Student Profile > Delete Student. Immediately deletes student and all associated behavior logs. Cannot be undone.
Delete Entire Account: Navigate to Account Settings > Delete Account. Immediately deletes ALL data. Cannot be undone.
Institutional Deletion Requests: Schools/districts can request deletion processed within 48 hours of verified request.
You have comprehensive rights regarding your information. These include rights to access, correct, delete, and export your data.
Access Rights
View all your account information, student data, behavior logs, and AI-generated insights.
Correction Rights
Edit student names, behavior logs, notes, or timestamps at any time.
Deletion Rights
Delete individual students, entire classes, or your entire account and all associated data.
Export Rights (Data Portability)
Export your data in CSV, JSON, or PDF formats. No restrictions on how often you export.
Objection Rights
Object to use of anonymized data for research or marketing communications.
Opt-Out Rights
Unsubscribe from marketing emails while still receiving essential service notifications.
We will NOT discriminate against you for exercising your privacy rights, including:
Denying you access to the Services
Charging different prices or rates
Providing a different level of service quality
Suggesting you'll receive a different price or quality of services
You must be at least 18 years old to create a BrighterBalance account.
We do NOT knowingly collect personal information directly from children under 13.
BrighterBalance allows teachers to record information about students, including children under 13. However, teachers (not children) enter student information, and the data is covered by FERPA (educational records exception).
Regardless of legal classification, we protect children's information by:
Not selling or sharing student information
Not using student information for advertising
Not creating profiles for non-educational purposes
Implementing strong security measures
Allowing parents to access and delete information
Training staff on children's privacy
Limiting data collection to what's necessary
In addition to federal FERPA requirements, BrighterBalance complies with applicable state student privacy laws.
California (CCPA/CPRA)
Rights to know, delete, correct, and opt-out. We do NOT sell personal information. Student Data covered by FERPA is exempt from CCPA/CPRA.
New York (Ed Law 2-d)
Parents' Bill of Rights including rights to know what data is collected, how it's used, and be notified of breaches. We execute supplemental data privacy agreements for NY schools.
Illinois (SOPPA)
Protection of student personally identifiable information, student materials, and transparency requirements.
Other States
We comply with Colorado (HB 16-1423), Connecticut (SB 1266), Maryland (SB 267), Texas (HB 2087), Washington (HB 1047), and others. Contact us for state-specific compliance information.

BrighterBalance is currently designed for U.S. schools and may not fully comply with the EU General Data Protection Regulation (GDPR). If you are in the European Economic Area (EEA), contact hello@brighterbalance.app before using the Services.
For material changes that reduce your privacy rights:
We will notify you at least 30 days in advance
Notice will be sent via email, website notice, and in-app notification
You will have the opportunity to review changes before they take effect
If you don't agree to updated terms:
You may stop using the Services
You may delete your account and data
You may export your data before the changes take effect
Continued use after changes take effect constitutes acceptance of the updated Privacy Policy.

Legal Disclaimer
This Privacy Policy does not create a contract or other legal rights beyond those provided by applicable law.
This Privacy Policy should be read together with our Terms of Use, our Data Processing Agreement (for institutional customers), and state-specific addendums (where applicable).
In the event of conflict, the Terms of Use govern general use of Services, this Privacy Policy governs data handling specifically, Data Processing Agreements override this Privacy Policy for institutional customers, and applicable law prevails over these documents.
